    Folks, wanted to share the feedback from my immigration attorney, the attorney office which did my h1b, h4, eb3 etc, it is a pretty big firm and has good reputation.

    The attorney clearly told me, that as long as there is no salary and if it is volunteering then we can go ahead whether it is profit making or non-profit it does not matter.

    Now im still confused what do i do......

    to be on safer side i may suggest going for non-profit org.

    Anotehr question in thsi regard, say ur I-94 expired and you applied for and got h1 renewal, and the new I-797 has the new I-94 in it, so we cut it from there and staple it to our passports ???

    And when we leave the country we surrender both the I-94s ???

    No the current one!

    The fee increase is only for companies which has more 50% of their employees on H1B visa. So counting 85K visa's for 4 years is not correct.

    i don't normally go for tricked-up stuff, but this one kind of hooked me. I did the "Ansel Adams" conversion to B&W which gave me a contrasty and "antique' look. Then I merged it with the original at about 45%.

    This gave the shot a very surreal look.

    If your company is paying for GC, then go ahead and apply for GC and hope 140 will be approved, so that u can apply for H1.

    Yes you have run out of time, since you have already crossed the 365 day limit before 6 year ends, before which u needed to apply for GC. Otherwise you could have applied for H1 renewal based on GC application. Now u have only 3 options.

    1. Go back to India after 6year expires
    2. Hope 140 gets approved before sept 30, 09 and apply for premium processing h1 if you want h1 to be done quickly
    3. Convert to F1...you can send the papers for F1 to your college and you can have that available without affecting your H1, until u begin using F1 status

    - My 485 is filed more than 6 months ago
    - My is 140 not approved yet
    - I get laid off
    - My employer doesn't revoke my 140
    - I'm already in the 8th year of my H

    So, I can go find another employer since I have my EAD and my 485 is filed for more than 180 days. Now, if my 140 is approved, no problem. If, however, my 140 gets an RFE or if my 140 is not too strong, I can find out alternatives including (but not limited to :-)) finding a decent job in my home country while I still have a job here in the US.

    Is it logical or should I go take a nap? :p

    Doesn't hurt to record conversation though - the most that will happen is that the lawyer will say that it is not admissible in a court of law.

    If the other party came to know that the conversation was recorded, they can counter sue.

    I think USCIS should be blamed because all those previous years visa numbers which are lost because they can't adjudicate the cases on time. We invested our time, resource and money for each and every step. We pay social security and taxes to run the economy. Most of us are here in "UNKNOWN" status but we are called resident and spent many many years.
    I have mixed feeling on if government/congress is serious about fixing this issue because 10 years doesn't sound very positive.

    It looks like immigration issue is hen that give golden egg ($ for the economy) Paper wok, Attorney frees postal fees gov fess etc. Does anyone would like to fix it?

    Please share your thought.

    1) Will the green card be worth after 10 years?
    2) Is there any grantee this mess will be cleared in 10 Years?
    3) Is time spent in path to immigration will be joyful and peaceful?
    4) The time away from back home Close family and you may have already missed your nearest and dearest family function. your child niece, nephew and other close relative bonding that your had when you'r child and had all this which you may be sacrifice for the path to immigration

    Please rethink what important and how to get an attention from the right people

    Keeping H status for the Primary applicant (H1B) may sometime act as 'failover pair' ... But in these days of Highend Retrogression (specially if you are from India/China/Mexico) getting a GC would take 7-10 years - does it makes sense staying in H1 even for the Primary ???

    I mean personally i've lived ( read 'did slavery') in US for sponsoring employees in H1 for 8 years and i wish to keep H1 as 'failover pair' but doing another 2nd term of slavery of 8 years till GC approval/denial comes - that has no sense at all. Its a 'No-Brainer' ....

    Moreover the depends - peoples who are new in this country 2-3 years and got EAD due to July Fiasco they can still continue H1 game but folks who already lived 6-7 years on H1B they can easily go to market and play...

    Advantage :- One advantage of EAD also is that if you lose your Job there is nothing called "revoke EAD" like "revoke H1B" so you can sit Jobless and sleep over for entire 8 years if you want and able to do :) :)

    I agree with you..it depends how much time is left on H1.he can easily switch to H4

    Thanks for your reply. I am also in the same dilemma over where to file, according to I765 instructions i need to mail to NSC but my I140, I485 ,EAD and AP all are in TSC. Customer Service rep tells me to follow the Instructions in I765 form for where to File.

    You do not have to apply for new SSN but do the following taken from SSA website:

    If your work eligibility has changed or if have become a U.S. citizen, you must apply for a replacement card. Your replacement card will no longer read �Not Valid for Employment,� but you will retain the same Social Security number.

    To get a replacement card:

    Complete an Application For A Social Security Card (Form SS-5); and
    Show us documents proving your:
    Immigration status;
    Work eligibility; and
    Identity.
    Take (or mail) your completed application and documents to your local Social Security office.
    All documents must be either originals or copies certified by the issuing agency. We cannot accept photocopies or notarized copies of documents.

    We will mail your number and card as soon as we have all of your information and have verified your documents.
    For details about the type of evidence you must provide, see Social Security Numbers For Noncitizens (Publication No. 05-10096) or Documents You Need for a Social Security Card.

    Man, I lost my patience with them long back.
    My case is NSC-EAC-NSC
    I keep a log of anything "useful" I am told every time I speak to them. And usually, the first few mins are wasted in them giving me wrong info, me telling them what they told me last time and them finally agreeing with it after re-checking their screens.


    btw .. it is indeed super-frustrating and unacceptable they way they are bouncing your case around.
    Why is USCIS forgetting that we are paying for their third grade services?




    I broke my politeness today.USCIS inconsistency broke the limits for me.

    My case was filed in Nebarska then tranferred to Texas then as soon as the priority date became current, last month, it was transferred to California.

    I talked yesterday to customer service and it by chance got transferred to California Service Center where the officer told me that my case was transferred back to Texas Service Center on August 14, 2008. She also told me to call TSC to confirm it.

    I called today the National Customer Service Center (NCSC) to confirm it and the lady tells me that the case is still in California and she has no more infomation about it. I told her about my call yesterday.

    Lady: How could you have ever called CSC because their phone numbers are not public
    Me: I called the same number and for some reason it got transferred to CSC.
    Lady: Then you have already been told that your case has been transferred back on Aug 14, what do you need now ?
    Me: The website does not show that. Plus the officer yesterday asked me to confirm it which you are not doing, you are just repeating my words about my conversation. There are so many inconsitencies . You told me just now that my case is still in California.
    Lady: Can you please hold for a moment.
    After hold:
    Lady: I just talked to my supervisor, if the website says it is in California then it is California. Is there anything else I can help you with ?
    Me: I do not understand "To speed up processing " clause in the reason to transfer it to california. It has been transferred from the center which is processing 485 applications to the center which is not processing applications. So the clause "To speed up processing" is so inconsistent.
    Lady: Sir, we cannot tell you the reason why do we transfers
    Me: But you have already told me the reason in the written notice as "To speed up processing"
    Lady: It is not "To speed up processing " it is "for processing". Is there anything else that I can help you with ?
    Me: I hang up the phone.

    You probably won't get a FP notice if you have done biometrics done before for I-485.
    So may just have to wait for approval.

    This is not consistent. I filed on Apr 18th. Last LUD on apr 27th.They received the documentation that day. My fried filed 3 weeks ago. He got a FP notice. Both were efiles. He has also done his FP along for 485.

    I dont want your colour to change but media keeps writing stuff,i guess we are intelligent enough to make our informed judgements.
    I do respect your view if you hold that as per your own judgement but I feel the time calls for teaming up with President rather than going after him.
    This will do us good I guess.Rest, its your color,you can decide which one you want to wear:)

    :) Alright lets leave the prez alone :p . Just curious, do you think this can move through senate, house and conference committee by august? I am following this drama for 2 years and my conclusion is that legislative action takes a lot of time from initiation to completion. With presidential politics building up for next year's election it will be very challenging to pass any law with the limited time on hand.

    Correct - None is the answer! My law firm (Fragomen) didnt ask for them when they submitted my docs on JUly 2. Maybe they are needed if the USCIS comes back with an RFE.

    I think if your case is pretty straight forward, there should be no problem without W2. What's the point to have it anyway? Some people do not even work for the petition employer since GC is for a future job. Right?
