    I-140 is for future GC and hence, must be full time and permanent.

    I-140 is not for current H-1B job.

    They almost always take some kind of FPs. What I mean is that there are 3 biometrics codes. Code 3 is the most comprehensive, where they take your photo, signature and all ten fingers FP. Check your notice in the upper right corner, there should be a box that says "Code".

    I always used to think (and still think) why they would issue different FP codes to different applicants even though they are all applying for same 485 petition?

    Do different codes have different relevance?

    My friends check encashed today from TSC. His Attorney send application (6/20) to NSC and received there on 6/21.

    So long way to go... I am not sure next weekend estimate will also hold good for July 2nd filer. :) Don't kill yourself and it will not make it faster.:D :D :D

    Hi,

    If the Dems win control of the Senate, I expect no major changes for us. The amnesty bills are already passed easily in the Senate as is anyway. That doesn't change anything for us there.

    In the House, this will be a close race. Even if Dems barely win in the House, what is less likely, then they may well find themselves struggling again to get major votes for the amnesty bills. Remember that the amnesty bills got rejected in the House by large margin - and - enforcement only bills got approved there widely. Our stand alone SKULL bill - not sure whether that will be considered by Democrats. Democrats will probably address the Dream Act before they take over the SKULL bill. Let them pass Dream Act, and then we, the Employment Base applicants will be in a real dream for a long time.

    Ombudsman, you forgot one important point however.

    If the Dems do win the house, the speaker will be a Dem. and she will set the agenda to be discussed and voted upon. Also the ranking members on the various comittees will also be Dems. Therefore they will make the decisions such as, when and how to discuss these measures in committee, when and with whom to hold congressional hearings(expert testimony), when to go to conference and which representatives to to go to conference, and so on, these things influence the legislative process as much as votes do.

    The bottomline is House Republicans had a fair shot at this and decided against any changes, I can't see how them returning is going to solve a thing. Immigration is one of the few issues that the Upper House and the Pres. can agree with a democratic congress on. Issues such as Soc. Security, healthcare etc will certainly end up in gridlock as the republican strategist Ed Rollins points out.

    I don't know why what (s)he has done to India or U.S or any other place should be any of our business? What has that got to do with his/her depression about not receiving GC? Why is that as soon as someone poses a simple question, people tend to get on the moral high-horse? BTW, the poster never said (s)he is going back yet.

    2: just don't lose hope. Your day in the sun will come. I am kinda in the similar situation as you are too (came in 1999, PD of 2002, was in the labor backlog for 5 years...). Just keep your chin up. As someone else said, you are getting closer to your GC.

    my opinions in bold
    Both parties ( employee and employers) bend letter and spirit of law. Think fake resumes, references, experiences on employee side. Think no salary on bench, lack minimum professional decorum, professional ethics on employers side. But overall my sympathies are with employee and more so in this case.

    In > 90% of cases I have seen, Desi employers dont operate on good faith. A good example is punitive damages. The employer does h1B, incurs about 5K cost and expects the employee to serve out 12 months. The exit clause is 25K. Its downright silly and precisely what causes employee anxiety. Instead if it is prorated for stay, it would be fair for every one involved.

    -- 25k because its just not about H-1b costs. Its business. Business needs to make profits and be healthy. Business dont want H-1B employees who would like to stay for less than an year. It affects other H-1B employees and their immigration process. Businesses hate to ask H-1Bs from INS and cancel H-1s. It puts a blotch on the Business. Afterall INS give H-1B approval hoping that the employee works with the employer for atleast 3 years .


    Hoarding I-140, labor certificatio etc and giving no visibility is another deal breaker.I just dont get it.

    Some one commented its a small world, apologize if necessary blah blah. If, for a minute the employer in this case thinks in positive way, ( My former employee would be at this place, couuld be in a position where I can sell more, i could get referral for new employees) he wouldnt be doing something like this which downright irresponsible and can cause significant damage to his shareholders. Being a small world goes on both sides.

    Thats pretty optimistic and long term thinking.

    For a techie, clilent is king. I would never displease the ultimate beneficiary of my services. Even after my project is over, I keep in touch, do occasional free consulting all in hope of building my network. But for employers like these, who add no value, i have no sympathies.

    We want to do some thing for elimination of backlogs Especially for EB3 - India Else we wont see any more progress.

    All EB3 people please share your thoughts to resolve this issue.
    Unless and untill everybody in EB3 has contributed ataleast a $1000.00 to the immigrationvoice cause, its waste of time to discuss about the EB3-India movement. Any way we have to spend a lot more than $1000.00 in renewing EADs, H1Bs and H4s.


    Otherwise just wait and pray for the CIR bill to pass. Then every body in the EB category will get the benefit being the EB3- India/China are the greatest benefitters.

    Finally one question to ALL.
    If we see a good action plan from IV Core and a date, how much are you willing to contribute.I am now ready to do $2000.00 instead of $500.00 as I said before. I am not very well-off to do this much (my friends are, though). But this looks to be nothing when compared to the loss many faced waiting 5-10- years. So I will do.
    Feel free. Remember how it feels like if you get it. and dont forget how much you are spending now for different immigration related issues. How much are you ready to contribute to IV.

    Tell me one thing - Why do you expect IV core to spoonfeed everything to you and your friends. If you and your friends are raring to go and do something for the retrogressed community, why not come forward with ideas and show some efforts, instead of just harping on a forum with a bundle of dollars in your hand! Remember, IV is made up of you and me, and it's you and me who can make all the difference. It's very easy to sit on the sidelines and talk. And one more thing - "Have a positive attitude" about everything (life, IV, GC etc) and you will notice how much your point of view will change for better.

    The best advice I have for you is to join your state chapter because IV does lot of its planning and strategy implementation behind the scenes. That way you will know more about IV's current and future plans, and will be able to contribute in a positive manner.

    My application was sent on Aug 7th reached USCIS (NSC)on Aug 8th. Recieved my reciept # on Sep 24 from lawyer. But my wife hasn't recieved the RN. Was wondering if any one are in the same boat.

    You all do amazing work and provide great information.I just did my first contribution of $100 and have become a recurring contributor for the same amount.If needed I will increase my contribution for March and April, as I will not be able to attend the event due to Family.

    I tried to convince 4 EB3 friends with a priority date between mid 2002 and late 2003 , and all of them have lost hope for GC and they are just very pessimist about the process .

    There are some who are concerned about not getting green cards , but give the excuse of being busy.I am trying to convince them to contribute and attend.

    Well guys...

    I agree that India is a land of pollution - polluted air and polluted minds (corruption, jealousy, materialistic attitude), it is still a very native part of our life. No matter where we live on this planet, whatever hapens in India, we do get affected by it.

    I just visited India after 7 years. As far as India goes, I love:

    -- My parents living there, perhaps they will never come to USA to stay with me permanently, and
    -- The school kids I see on road in their school uniform, waiting for their school vans or walking as a group, making jokes and laughing out of their breath.

    I always wonder that they do not know what hardhsip lies ahead of them, when they grow up after finishing their school - competition to get college admission, studies, competitive jobs, corruption, ever rising cost of living, etc. etc.

    Most of my old friends in India have gone too busy in making money and 'rising on the top". It is as if they are in some kind of a race in panic, so they don't get left behind everybody else and what not.

    What does "rising on the top" mean anyway? Whom are you collecting money for?

    I recently bought the latest Samsung 3D LED TV to have a better movie experience. And I noticed that I enjoyed movies on small 22" inch TV more than I enjoy on a big LED TV - provided the movie is good and I have a good company.

    So my friend (who is leaving for India)...

    You can find happiness and joy in little things in life, irrespective of where you are staying. These commodities are not exclusively sold in India or anywhere else.

    If you have made a decision to move to India, be proud of it and do it! Just set a good example in india and don't get involved in the dirty corrupted cycles there.

    I-140 is for future job, and the petition says that the original employer has *intent* to hire the petitioner on FT/"perm" job. Now, let's say the original employer withdraws the petition after 180 days of filing I-485 and approved I-140 and lets you go. That's where AC21 comes to rescue, and you can become "self-employed" rather than "unemployed." Question is, why can't self-employment in same/similar occupation as your I-140 petition be considered to satisfy I-140 requirement? (Fortunately, yes it can be, per Yates memo.) Another situation: If you continue working with the same employer on H-1B until you get your GC, and leave him the next day of getting GC, and then plan to take a long holiday (not working). Would your GC be canceled because you don't have a FT/"perm" job?

    I-140 is for future GC and hence, must be full time and permanent.

    So is it a problem if you try to go for landing AFTER you apply for AOS?
    What about those who landed before they filed i-485?

    I google'ed and came across not-so-good information about this.

    or just google "canada landing while I-485 pending" and read other links as well. Some attornies think accepting canada greencard MAY impact USA greencard! :eek:

    I just tried accessing my case status on line and I see the folowing message.

    This message is like their Visa Bulletins, 6.00 PM on May 10th,2009?? India, EST, CST, MST, PST, Alaska , Hawaii or china time?


    Portions of the CRIS application are unavailable for scheduled maintenance.
    We anticipate that the application the will be available by 6:00 PM on May 10th, 2009.
